1. General Provisions

1.1. This User Agreement (hereinafter referred to as the "Agreement") governs the relationship between the Service Provider and the User regarding the use of the Synchronist platform (hereinafter referred to as the "Platform").

1.2. By accessing or using the Platform, the User confirms acceptance of this Agreement.

1.3. If the User does not agree with any provisions of this Agreement, they must stop using the Platform immediately.

1.4. Beta Disclaimer: The Platform is currently in beta testing. Users acknowledge that some features may not work as intended, and the service may be modified or discontinued at any time. The Service Provider is not responsible for any temporary interruptions, data loss, or unintended results.

2. Scope of Services

2.1. The Platform provides tools for text translation and voice-over at playback speed using Google Translate.

2.2. The Service Provider strives to ensure the continuous operation of the Platform but does not guarantee uninterrupted availability. The Service Provider reserves the right to modify, suspend, or terminate the services at any time, with or without prior notice.

3. DUser Obligations

3.1. The User agrees to use the Platform in compliance with applicable laws, ethical standards, and the rights of third parties.

3.2. The User is solely responsible for any content uploaded, processed, or shared via the Platform.

3.3.The User agrees not to:

  • Engage in fraudulent, unlawful, or deceptive activities;
  • Upload, transmit, or distribute malicious software or harmful content;
  • Infringe upon the intellectual property or privacy rights of third parties;
  • Use the Platform for purposes that violate applicable regulations.

4. Intellectual Property

4.1. All intellectual property rights in the Platform and its components belong to the Service Provider or its licensors.

4.2. The User is granted a limited, non-exclusive, non-transferable license to use the Platform solely for personal, non-commercial purposes. Any unauthorized reproduction, modification, or distribution of the Platform’s content is strictly prohibited.

5. Privacy and Data Protection

5.1. The Service Provider processes User data in accordance with the Privacy Policy and in compliance with the General Data Protection Regulation (GDPR) and applicable Portuguese data protection laws.

5.2. Users have the right to access, rectify, delete, or restrict the processing of their personal data as outlined in the Privacy Policy.

5.3. The User consents to receiving service-related communications. Promotional messages will only be sent with explicit consent and can be opted out of at any time.

6. Liability

6.1. The Platform is provided on an "as is" and "as available" basis, without any express or implied warranties regarding uninterrupted operation, accuracy, or fitness for a particular purpose.

6.2. To the extent permitted by law, the Service Provider shall not be liable for:

  • Any direct, indirect, incidental, or consequential damages arising from the use or inability to use the Platform;
  • User-generated content, including its legality, accuracy, or impact;
  • Third-party services integrated into the Platform, including Google Translate.

6.3. The total liability of the Service Provider under this Agreement shall not exceed the amount paid by the User for accessing the services within the preceding three months.

7. Termination

7.1. Either party may terminate this Agreement at any time.

7.2. The Service Provider reserves the right to suspend or terminate User access if the User violates this Agreement, applicable laws, or engages in conduct that may harm the Platform or other Users.

8. Amendments

8.1. The Service Provider may update this Agreement at any time. Users will be notified of significant changes through the Platform or via email.

8.2. Continued use of the Platform after updates constitutes acceptance of the revised Agreement.

9. Governing Law and Dispute Resolution

9.1. This Agreement is governed by the laws of Portugal and the European Union, including GDPR and applicable national data protection regulations enforced by Comissão Nacional de Proteção de Dados (CNPD).

9.2. Any disputes shall first be resolved through negotiations. If no resolution is reached, disputes shall be settled in the courts of Portugal in accordance with applicable law.

10.1. Synchronist is developed by a team of entrepreneurs under the Portuguese Startup Visa program. The project is in the pre-company stage and currently operates as a non-commercial initiative.
